I. GENERAL BUSINESS ITEMS – 6:30 P.M. CITY COUNCIL CHAMBERS
Board Member Fallows noted that Board Member Troy Teeples and Board Member Gary Chandler are both absent.
Board Member Wareham motioned to delay this item until the next meeting. Board Member Fullmer seconded the motion. Motion passes unanimously with Board Members Troy Teeples and Gary Chandler absent.
Board Member Wareham motioned to approve the March 28, 2007 Board of Adjustment Agenda. Board Member Fullmer seconded the motion. Motion passes unanimously with Board Members Troy Teeples and Gary Chandler absent.
D. Approval of the Minutes of the Meeting held on September 20, 2006.
Board Member Warham motioned to approve the September 20, 2006 Board of Adjustment Minutes. Board Member Fullmer seconded the motion. Motion passes unanimously with Board Members Troy Teeples and Gary Chandler absent.

III PUBLIC HEARING ITEMS
A. File # BOA-2007.01, Request for a variance to Section 17.132.150 Letter “D” of the South Jordan Zoning Ordinance pertaining to front yard fencing. Property located at 2607 West North Forty Way, Brittany Oler, (applicant).
City Planner Brad Sanderson reviewed the background information on this item. He said basically the applicants want to replace their old eroded 6’ fence with a solid vinyl fence for privacy issues.
Board Member Wareham asked about the meaning of “Clear Vision Triangles.”
City Planner Sanderson said there would need to be a 10’ clear vision to the left edge of the fence. Deputy Director Schindler pointed out the areas that are to be “clear vision” on the map displayed.
Board Member Fallows opened the Public Hearing and asked if the applicant is present.
Mr. Oler (applicant) referred to some pictures of his yard. He said the existing fence is an old cattle/livestock fence. He said the fence posts are all eroded and they wanted to replace this with a solid vinyl fence for privacy issues. He said 15’ of their property is taken up by an easement that leaves them with a very small back yard. He said another issue is a new home going in behind them and from the neighbors back yard they can see directly into the backyard. He said the cub-cut is hard to show on the illustration. He said he understands that if they were to request a wider curb-cut he knows he would have to take the fence back.
Board Member Wareham asked Mr. Oler to define the lines of the clear vision and the curb-cut with respect to the garage.
Board Member Fullmer asked Mr. Oler if the property to the west has an exit to the street. Mr. Oler said not at this time. He said the neighboring property has a 20’ chain link fence but it does not extend to the end of the boundary. He said there is also a 6’ wood fence that comes to the front. He said they don’t have a driveway to the street.
Board Member Fallows asked Mr. Oler if they have spoken with their surrounding neighbors about putting in the fence. Mr. Oler said yes with the exception of the Butterfields. He said everyone was supportive and had no concerns with installing a vinyl fence.
Brittney Oler said that they have started a family and wanted to make a safer area for their children.
Board Member Fallows closed the Public Hearing.
Board Member Wareham asked about the neighbors across the street to the east and what type of fencing they have on their property. Mr. Oler said they do no have a fence currently but could do so if they wanted to.
Board Member Wareham said he was mainly concerned about backing out onto North Forty Way and the safety of anyone blocked from view.
B. Potential Action Item (See III. A.)
Board Member Wareham motioned to approve File # BOA-2007.01, Request for a variance to Section 17.132.150 Letter “D” of the South Jordan Zoning Ordinance pertaining to front yard fencing on property located at 2607 West North Forty Way. Board Member Fullmer seconded the motion. Motion passes unanimously with Board Members Troy Teeples and Gary Chandler absent.

Board Member Fullmer commented about the meaning of “District Zoning.” He said he has since done research and found that “District” does not necessarily mean zone. He said zone can also mean neighborhood.
VI ADJOURNMENT
Board Member Wareham made a motion to adjourn. Board Member Fallows seconded the motion. The vote was unanimous in favor with Board Members Troy Teeples and Gary Chandler absent.
The March 28, 2007 Board of Adjustment meeting adjourned at 7:10 p.m.
