REGULAR MEETING

 

I.          GENERAL BUSINESS

 

            A.        Welcome and Roll Call

 

Mayor Money welcomed everyone present. All members of the City Council were present.

 

Mayor Money recognized some scouts present. Scout Troops 1688, 293, and 1534 were introduced.

 

            B.        Opening Ceremony

 

1.            Invocation

 

Council Member Butters offered the invocation.

 

2.         Pledge of Allegiance

 

Connor Wheaton, scout, led the audience in the Pledge of Allegiance.

 

C.        Motion to Approve Amended Agenda Items, If Any

 

CM Geilmann said items VI. A.1. and A.2. need to be pulled from the agenda.

 

Council Member Winger made a motion to pull items VI. A.1. and A.2. from the agenda, and to approve the agenda as amended. Council Member Short seconded the motion. The vote was unanimous in favor.

 

D.        Minute Approval

 

                        1.         October 18, 2011

 

Council Member Butters noted two changes to the minutes.

 

The minutes will be carried over for approval at the next City Council meeting.

 

II.         AWARDS, PRESENTATIONS

 

A.           Bingham High School Musical “Beauty and the Beast” Invitations.

 

Michelle Wilden said Beauty and the Beast will be opening at Bingham High School on November 11th and running through November 22nd. She indicated that they have a large cast. She invited all to attend and handed out complimentary tickets to the Mayor and City Council.

 

Council Member Winger thanked Ms. Wilden for her help on Constitution Day.

 

            B.        Daybreak Signage Master Plan

 

Stephen James, reviewed the Daybreak Signage Master Plan presentation (Attachment A).

 

Mayor Money asked if there are other areas in the country where the sign guidelines have been used? Mr. James said they developed this plan; it has not been used elsewhere.

 

Mr. James reviewed pictures of various sign types.

 

Council Member Johnson asked if they want continuity between the projects or do they want it free flowing? Mr. James said currently, there is no continuity. They want them designed and coordinated together.

 

Council Member Butters asked about the language discouraging bright florescent coloring, but encouraging bold colors. Mr. James said black and white are an example of bold coloring. He said florescent colors blend the way they reflect the light.

 

Mayor Money asked what is staff’s impression of this proposal? Community Development Director Shaw said they have confidence in the proposal. It was noted that the City has made changes to their sign Ordinance and implemented some of the concepts presented. He said staff is in favor of this. He said staff will continue to make suggestions on the concept. Planner Schindler noted that staff has been working with Daybreak for several months on this issue.

 

Mr. James said they are looking for further feedback. The Mayor and City Council agreed that this is an exciting proposal.

 

City Attorney Wall said they could find themselves, in the next 3-4 years, in a position where they won’t be putting signage on public property because of what they are required to do to meet first amendment standards. He said this is good for Daybreak to expand signage on private property. Council Member Butters asked if this would preclude them from placing signs on City owned property? City Attorney Wall said generally no, they are okay as long as the sign is regulatory or the message addresses a City event.

 

III.        CITIZEN COMMENT

 

Richard Dunn, 9802 Lampton Cir., said he was at the City Council meeting a couple of years ago for a public hearing about putting in apartments. He said he was vocal against it because he had lived in Millcreek, and when they built apartments by him, gangs and various crimes followed. He said since the South Jordan apartments went in, there has been a lot of graffiti on the river walk. The police were very responsive and cleared some of it. He hasn’t noticed any new graffiti, but was upset about seeing it.

 

He indicated that from the City Council meeting, he has become more politically active. He said he would have preferred to have been told that the City Council had to vote the issue through and their hands were tied. Instead, the issue was voted down unanimously, and then he understands that it was voted up a couple hours later in private. He said it would be better if the process was more open.

 

Council Member Taylor said the issue couldn’t have been approved, legally, the way he described it. Council Member Johnson said it was not done in private.

 

Mayor Money encouraged Mr. Dunn to research and find out how the approval was done. He said it did not happen in secret. They discussed what can be discussed in a closed meeting, and noted that no votes are taken in those meetings. The apartments were approved about 4 years ago.

 

CM Geilmann said he would work with staff to resolve the issue. Mr. Dunn outlined where the graffiti is still located.

 

Police Chief Shepherd said 2 weeks ago, 3 individuals were arrested and that should solve about 90 percent of the graffiti that has taken place. He said the individuals didn’t come from the apartments. They were active and also sprayed graffiti in surrounding cities.

 

Mr. Dunn said he would like to see the river trail completed. Mayor Money said they can’t go past 9800 South. That section is in Sandy City. Council Member Taylor said the Jordan River Commission is looking at purchasing some of the property to complete the trail. Mr. Dunn said the graffiti evidence will ruin the trail.

VI.       PUBLIC HEARINGS AND POTENTIAL LEGISLATIVE ACTION ITEMS

            B.1.     Public Hearing – Sale of Property at 3200 West 11400 South

 

ACM Whatcott reviewed the background information on this property. The purpose of the sale is to recoup the costs spent on the improvements on 3200 West and put the money into green space.

 

Mayor Money opened the public hearing.

 

John Stevens, 11369 Stoker Cove, said he appreciates the time ACM Whatcott spent with him. He made an offer to purchase the property, but it was far less than what the City would like to get out of the property. He said he still feels that the neighbors have concerns about what might go on the property. He asked if homes will be built on the property?

 

ACM Whatcott said the proposal is to leave it at R-2.5.

 

Mr. Stevens asked if consideration could be given to restrict the homes to ramblers? He said the neighbors were hoping for a park. He said he has a great view in the back of their home. He said his offer still stands and they can negotiate further.

 

Mayor Money asked if Mr. Stevens has talked to his adjacent neighbors? Mr. Stevens said neither neighbor is in a financial situation to purchase the property. He said his proposal was to do a park and do an entrance from the north side of his yard. He said they could even put an entrance to the property from the corner of 11400 South. He said he hopes that the City will consider his offer, if there are no other better offers so they can re-negotiate.

 

Kevin Zanger, 3228 W. 11340 S., said what Mr. Stevens offered to do for the neighborhood was amazing. It is too bad that they could not come to an agreement on that. He said they love the area. It is sad to think that in this little area they could cram 3 houses. He said they chose this area because they had space. He said in the last meeting on this property, they were concerned about the aesthetics of the area. He does not feel that putting three houses on this property will look good. He said it will look awkward and detract from young professionals wanting to locate in the area. He said he is concerned about house values. He said it sounds like the plan is to increase the water retention area.

 

Mayor Money said they need to make sure the basin handles all the water that it needs to. Mr. Zanger said he heard that the water retention area will remain as weeds and will not be landscaped. CM Geilmann said that is a rumor at this point. Mayor Money said it will certainly be an improvement over what they have now.

 

Council Member Taylor said they should look at multiple uses for the retention basin and see if it can be used as a place to play.

 

Mr. Zanger said he fears a gas station could be put on the property. Mayor Money said that won’t happen. The property is zoned residential.

 

Mayor Money closed the public hearing.

 

            B.2.     Potential Action Item – (See VI. B.1.)

 

Council Member Winger made a motion to authorize staff to offer the property at 3200 West 11400 South for sale, and to come back to the City Council with an offer. Council Member Short seconded the motion. Roll call vote. The vote was unanimous in favor.

 

Council Member Taylor said they feel a stewardship to bring the value of what the City spent back for the citizens.

IX.       INFORMATIONAL ITEMS AND OTHER BUSINESS

 

            A.        CALENDARING ITEMS

 

The City Council noted the upcoming election canvassing meeting on November 22nd.

Council Member Butters asked if they can move this meeting to November 15th? CM Geilmann said they need the full Council at the canvassing meeting, and not everyone will be present at the November 15th meeting.

 

Council Member Taylor said early voting is going on all week at any polling place.

 

B.           COMENTS FROM MAYOR AND MEMBERS OF THE CITY COUNCIL

 

Council Member Winger said the Youth Council recently planted hundreds of flowers. She said they have an Auswitch survivor that spoke to the group.

 

Council Member Winger expressed appreciation to Marlene Stanley and her group for their work with the South Jordan Choir. The Sounds of the Season will be held December 9th and 10th. Light the Night is scheduled for December 2nd at 6:30 p.m.

 

Council Member Butters said he recently had a conversation with City Engineer Klavano regarding the street that exits their subdivision onto 4000 West. That asphalt has now been repaired and replaced. He thanked staff for taking care of the streets.

 

Council Member Taylor thanked staff for the landscaping done around the emergency road. The neighbors are happy. She also thanked staff for cleaning up 445 West. The scout who requested the clean up was very excited to see it was done.

 

Mayor Money thanked Mayor Mia Love from Saratoga Springs for joining their work session.

 

            C.        CITY MANAGER BUSINESS

 

Director of Management Services Brian Preece gave the City Council a commerce update. There were 19 business licenses issued in October; 10 licenses were Home Occupations, 9 were General Licenses. Schmidt’s Bakery recently opened. He met with representatives from Hilton Worldwide. They looked at the TOD site near I-15 and Daybreak. They really liked the Daybreak site. They are coming back in December. He had dinner with the Forest City representatives. They are still actively doing their due diligence for the TOD site in South Jordan. Forest City feels they would do a better job if they did the whole development down the Frontrunner line. They feel South Jordan is the best positioned site to do the most vibrant TOD along Front Runner. They met with a representative from Solmus Engineering who is bidding to be the design team for eBay. Phase Two is happening in the Spring. It’s looking like phases 3 and 4 are a more real possibility. They met with a developer that does mixed use development; it is 33 percent owned by Goldman Sachs. They could be a backup option for Forest City or a partner in some housing. He said they’d like to bring in Goldman Sachs in the office space. He will also be talking to GE Capital. They have a wide variety of people looking at the TOD site.

 

Council Member Winger said she would like staff to pursue locating Geneva’s headquarters in the City. She also indicated that RiverPark was named Best Office Park in Utah.

Council Member Winger made a motion to adjourn. Council Member Butters seconded the motion. The vote was unanimous in favor.
